I would ask your sister and her husband to discuss it. If your nephew wants to play under your supervision and they allow it, then I don't see a problem. You watch. He plays whatever time he has when he visits.
Just leave it there and if they say no, then delete it or do whatever you want with it as it's yours.
Biggest thing is that he's playing while supervised and that both his parents are okay with it.
